There's a plausible argument that no, it couldn't stop that, because under Article V, the amendment becomes effective as soon as the 38th state ratifies, but there's no question that this deadline exists; it's out there. And the best thing to do, the easiest thing to do, the clearest thing to do, is just get rid of it. Then there would be no barrier.
